The named guarantors have authorized me to transmit their data. The guarantors' consent is not based on any deception or similar action on my part.

Declaration of good faith in the membership application

I confirm that my membership is of an exclusively private nature and does not serve the purpose of obtaining or forwarding information on behalf of or at the instigation of third parties. In particular, I confirm that I am not acting or have been employed for the purpose of obtaining information, surveillance or infiltration, irrespective of any professional activity with governmental organizations, authorities, non-governmental organizations (NGOs), government-related organizations (GONGOs), international organizations or their sub-organizations.

I undertake that I will not use or set up any existing or future communication channels - of any kind whatsoever - for the purpose of deliberately leaking knowledge and information from the UNITER NETWORK (all affiliated UNITER organizations and companies). This obligation applies regardless of whether I act on my own initiative or on behalf of third parties. A breach of this declaration constitutes a serious breach of trust and will have legal consequences.

Acting on behalf of an organization

If, contrary to this declaration, I act on behalf of a government organization, authority or other organization, I hereby confirm my authority to represent and sign on behalf of this organization and conclude the membership on its behalf. I acknowledge that in this case the contribution rate for members of public authorities will be calculated in accordance with the applicable regulations and will be payable immediately. I am aware that false information may lead to claims for damages.

Place of jurisdiction

Association law matters:
Swiss law applies exclusively to all internal association matters. The place of jurisdiction for association law matters is the registered office of the association in Switzerland.
International legal prosecution by UNITER as UNITER NETWORK:
By applying for and becoming a member of UNITER, legal prosecution under US law also applies. This applies in particular, but not exclusively:

a) Intentionally providing false or misleading information in the membership application
b) Direct or indirect financial damage to the network
c) Unauthorized disclosure of internal information
d) Violation of network agreements and confidentiality agreements
e) Actions that damage the network or its reputation
f) Cybercrime against the network or its infrastructure
g) Acts of economic damage

Legal consequences

The applicant/members acknowledge and expressly agree that:

a) Any harmful act against any part of the Network will be considered an act against the entire UNITER Network
b) Prosecution under U.S. law, in particular under:

RICO Act (18 U.S. Code Chapter 96)
FISA Act
Digital Millennium Copyright Act (DMCA)
Economic Espionage Act

c) The U.S. federal courts in the District of Columbia are designated as the primary venue for international legal action

Consent and acknowledgment

By signing the membership, the member confirms:

The full knowledge of these provisions
The express consent to the described legal action
The recognition of the jurisdiction of the U.S. courts in the cases mentioned
The understanding that this consent is irrevocable

Severability clause

Should individual provisions of this agreement be or become invalid, the invalid provision shall be replaced by a valid provision. The invalid provision shall be replaced by a valid provision that comes closest to the legal and economic intention of the parties.

Multilingualism

This agreement is drawn up in German and English. In case of doubt, the German version shall prevail.
